SECTION 2 – USE OF OUR WEBSITE AND ACCOUNTS

You may use our Services only for lawful purposes and in accordance with these Terms.

When placing an order or creating an account, you agree to provide information that is accurate, current and complete.

If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account.

You must not use our Services in a way that could unlawfully interfere with, damage, disable or compromise our website, systems, customers or other users.

SECTION 3 – OUR PRODUCTS

We take reasonable care to provide accurate product descriptions, photographs, specifications, measurements and other information.

However, colours and appearance may vary slightly from images shown on our website because of differences in lighting, photography, screen settings, devices, manufacturing batches or other reasonable factors.

Where dimensions or measurements are provided, minor reasonable variations may occur.

Images may sometimes be edited or presented in lifestyle settings for illustrative or promotional purposes. Customers should refer to the product description, specifications and available product information when making a purchasing decision.

We may update product information, change our product range, limit quantities or discontinue products at any time.

Nothing in this section affects your statutory rights where goods are faulty, damaged, not as described, not of satisfactory quality, not fit for purpose where applicable, or otherwise fail to conform to applicable consumer law.

SECTION 4 – ORDERS AND CONTRACT FORMATION

When you submit an order through our website, you are making an offer to purchase the products in your order.

After placing an order, you may receive an automated acknowledgement or confirmation email.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

* a product is unavailable;

* there is an obvious pricing, description or technical error;

* payment cannot be authorised or successfully processed;

* we reasonably suspect fraud, misuse or unauthorised activity;

* delivery to the supplied address is not reasonably possible; or

* we cannot fulfil the order for another legitimate reason.

If we cancel an order after taking payment, we will refund the appropriate amount using the original payment method, subject to applicable law.

Please review your order information carefully before submitting it, including product selection, variants, quantities, delivery address and contact details.

If you need to request a change or cancellation, contact us as soon as possible. We cannot guarantee that an order can be changed or stopped once processing or fulfilment has begun.

This does not affect any statutory cancellation, refund or other consumer rights that apply to you.

SECTION 5 – PRICES, TAXES AND PAYMENT

Product prices are displayed in the currency shown on our website.

The total amount payable will be displayed before you complete your purchase, including applicable charges that we are required to disclose.

Where applicable, taxes, delivery charges or other charges will be presented in accordance with applicable law and our checkout process.

We reserve the right to change product prices at any time. Price changes will not normally affect orders that we have already accepted.

From time to time, we may offer discounts or promotional pricing subject to separate conditions or eligibility requirements.

Payment must be made using one of the payment methods available at checkout.

By submitting payment information, you confirm that you are authorised to use the relevant payment method and that the information you provide is accurate.

If we discover an obvious pricing error, we may contact you before fulfilling the order. Where appropriate, you may be given the option to purchase at the correct price or cancel the affected order for a refund.

SECTION 6 – SHIPPING AND DELIVERY

We arrange delivery to the address provided when an order is placed.

Please ensure that your delivery information is complete and accurate.

Estimated processing and delivery times may be displayed on our website, product pages, checkout or Shipping Policy.

Delivery dates and timeframes are estimates unless we expressly agree otherwise.

Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier disruption, customs processing, severe weather, transport disruption or other unforeseen events.

However, nothing in these Terms removes or limits any delivery rights or remedies you have under applicable consumer law.

Where applicable law requires delivery within a particular period unless otherwise agreed, we will comply with those requirements.

If your order is significantly delayed, appears lost, arrives damaged or cannot be delivered, please contact us so that we can investigate and provide an appropriate remedy in accordance with applicable law.

Please see our Shipping Policy for further information about processing, estimated delivery and related matters.

SECTION 7 – CANCELLATION, RETURNS AND REFUNDS

Your cancellation, return and refund rights are described in our Refund Policy and are subject to applicable consumer law.

If you are a UK consumer purchasing eligible goods online, you will generally have a statutory right to cancel your purchase without giving a reason within the applicable cancellation period.

For most eligible online purchases of goods, this generally means notifying us that you wish to cancel within 14 days after receiving the goods, subject to statutory exceptions.

After notifying us of an eligible cancellation, you must return the goods within the applicable legal timeframe and follow the return instructions provided.

Certain goods may be excluded from change-of-mind cancellation rights where permitted by law, including certain personalised, made-to-order, perishable or hygiene-sensitive goods where the relevant legal conditions apply.

Your rights concerning faulty, damaged, misdescribed or otherwise non-conforming goods are separate from change-of-mind cancellation rights.

Nothing in these Terms or our Refund Policy excludes or limits statutory consumer rights that cannot lawfully be excluded.

IMPORTANT: Do not send returns to our registered office unless we expressly instruct you to do so.

Customers must contact us before making a return and follow the return instructions and return address provided for the particular return.

Please review our Refund Policy for full information about cancellations, returns and refunds.

SECTION 8 – PROMOTIONS AND DISCOUNTS

We may occasionally offer promotional discounts, discount codes, introductory offers or other promotions.

Promotions may have separate terms, eligibility requirements, expiry dates, usage limits or exclusions.

Unless otherwise stated, promotions and discount codes cannot be combined.

We reserve the right to amend or withdraw a promotion where reasonably necessary, provided that doing so does not unlawfully affect an order already accepted.

SECTION 9 – PRODUCT AVAILABILITY

All products are subject to availability.

Displaying a product on our website does not guarantee that it will remain available.

If a product becomes unavailable after an order is placed, we may contact you to offer an appropriate alternative where suitable or cancel and refund the affected item.

We will not substitute a materially different product without your agreement.

SECTION 10 – INTELLECTUAL PROPERTY

The content of our website, including our branding, logos, original text, graphics, website design and other original material, is owned by or licensed to Nordic Nook or the relevant rights holder and may be protected by applicable intellectual property laws.

You may access and use our website for lawful personal and non-commercial purposes.

Unless permitted by law or authorised by the relevant rights holder, you must not reproduce, republish, distribute, commercially exploit or create unauthorised derivative works from protected website content.

Product images, trademarks, brand names and other material belonging to third parties remain the property of their respective owners.

Nothing in these Terms transfers ownership of intellectual property to you.

SECTION 11 – THIRD-PARTY SERVICES, TOOLS AND LINKS

Our Services may rely on third parties, including technology providers, payment processors, fulfilment partners, delivery providers and other service providers.

Our website may also contain links to websites or services operated by third parties.

We do not control independent third-party websites and are not responsible for their independent content, policies or practices.

You should review the relevant terms and privacy policies when using third-party services.

Nothing in this section excludes or limits responsibility that cannot lawfully be excluded.

SECTION 12 – RELATIONSHIP WITH SHOPIFY

Nordic Nook is powered by Shopify, which provides technology that enables us to operate our online store and provide the Services.

However, purchases made directly from our store are transactions between you and Nordic Nook.

Nordic Nook is responsible for its obligations as the retailer in relation to products purchased directly from Nordic Nook.

Shopify is not the seller of products purchased directly from Nordic Nook and is not responsible for fulfilling Nordic Nook’s obligations as retailer, except to the extent that Shopify separately provides a service directly to you under its own applicable terms.

SECTION 13 – PRIVACY AND PERSONAL INFORMATION

We process personal information in accordance with our Privacy Policy and applicable data-protection laws.

Our store is hosted using Shopify and may use other service providers to help us operate our website, process payments, fulfil orders, provide customer support, analyse store performance or provide other necessary services.

As a result, personal information may be processed by third-party service providers where necessary and lawful.

Please review our Privacy Policy for further information about how personal information is collected, used, shared and protected and about your applicable data-protection rights.

SECTION 14 – REVIEWS, FEEDBACK AND USER CONTENT

If you voluntarily submit a review, photograph, comment, suggestion, feedback or other content to us, you confirm that you have the right to provide that content.

You must not knowingly submit content that is unlawful, fraudulent, defamatory, abusive, obscene, malicious or that unlawfully infringes another person’s intellectual property, privacy or other rights.

Subject to applicable law and privacy rights, by voluntarily submitting content intended for review, feedback or promotional purposes, you grant us permission to use that content reasonably in connection with operating and promoting Nordic Nook.

We may moderate or remove user-submitted content where reasonably necessary, including content that violates these Terms or applicable law.

SECTION 15 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, our website may contain typographical errors, inaccuracies or omissions relating to product information, pricing, availability, promotions, delivery or other content.

We reserve the right to correct genuine errors and update inaccurate information.

If an error materially affects an order you have already placed, we will handle the matter fairly and in accordance with applicable consumer law.

Nothing in this section allows us to avoid obligations or consumer rights imposed by law.

SECTION 16 – PROHIBITED USES

You must not use our Services:

* for unlawful or fraudulent purposes;

* to violate applicable laws or regulations;

* to infringe intellectual property, privacy or other legal rights;

* to transmit viruses, malware or other harmful code;

* to attempt unauthorised access to our website, systems or accounts;

* to interfere with the security or proper operation of our Services;

* to collect or process personal information unlawfully;

* to impersonate another person or organisation;

* to provide deliberately false or misleading information for fraudulent purposes; or

* to engage in activity intended to damage Nordic Nook, our customers or our service providers.

We may restrict or suspend access where reasonably necessary to protect our business, customers, systems or legal rights.

SECTION 17 – WEBSITE AVAILABILITY

We aim to keep our website and Services available and functioning properly.

However, we cannot guarantee uninterrupted or error-free access at all times.

We may temporarily restrict or suspend access for maintenance, updates, security reasons, technical problems or circumstances outside our reasonable control.

Temporary website unavailability does not affect statutory rights relating to purchases already made.

SECTION 18 – OUR RESPONSIBILITY TO YOU

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Nothing in these Terms excludes, restricts or overrides your statutory rights as a consumer.

Subject to applicable law, we are responsible for losses that are a reasonably foreseeable result of our breach of these Terms or our failure to exercise reasonable care and skill.

If you are purchasing as a consumer, we are generally not responsible for business losses, including loss of profit, revenue, business opportunity or business interruption, arising from a purchase made wholly or mainly for personal use, except where applicable law provides otherwise.

SECTION 19 – EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for delay or failure caused solely by events outside our reasonable control where permitted by law.

Such events may include severe weather, natural disasters, widespread transport disruption, major network or infrastructure failures, government action or other circumstances that could not reasonably have been prevented.

Where such an event materially affects an order, we will take reasonable steps to minimise the impact and will respect any cancellation, refund or other rights available under applicable law.

SECTION 20 – SUSPENSION OR TERMINATION OF ACCESS

We may restrict, suspend or terminate access to our website where reasonably necessary, including where a user materially breaches these Terms, engages in fraudulent activity, misuses our Services or creates a significant security or legal risk.

Suspension or termination of website access does not remove rights or obligations relating to purchases already made or provisions that by their nature continue to apply.

SECTION 21 – SEVERABILITY

If any provision of these Terms is found by a competent authority to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the minimum extent necessary.

The remaining provisions will continue in effect.

SECTION 22 – WAIVER

If we delay or fail to enforce a right under these Terms, this does not necessarily mean that we have waived that right.

A waiver on one occasion does not automatically constitute a waiver on another occasion.

SECTION 23 – GOVERNING LAW AND DISPUTES

These Terms and contracts between Nordic Nook and customers are governed by the applicable laws of England and Wales, subject to any mandatory consumer-protection laws and jurisdictional rights that apply to you.

Nothing in these Terms deprives a consumer of mandatory legal protections or rights to bring proceedings in a court that has jurisdiction under applicable law.

If you experience a problem with an order or our Services, we encourage you to contact us first so that we can try to resolve the matter fairly.

SECTION 24 – CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, Services, policies or applicable law.

The latest version will be made available on our website.

Changes will not retrospectively remove rights you have in relation to an existing contract where doing so would be unlawful.

Where required by applicable law, we will provide appropriate notice of material changes.

SECTION 25 – ENTIRE AGREEMENT

These Terms, together with the policies and other terms expressly incorporated by reference, form the agreement governing your use of our Services and purchases from Nordic Nook.

Nothing in this section limits rights or protections that cannot lawfully be excluded.
